These Terms of Service (“Terms”) govern your access to and use of the SOUVARE website, online store, products, services, features, and related communications (collectively, the “Services”).

Shopify provides the technology supporting our online store but is not the seller of SOUVARE products.

By using our Services or placing an order, you represent that you have the legal capacity to enter into a binding agreement under the laws applicable to you.

If you are under the age of legal majority in your jurisdiction, you may only use the Services with the involvement and authorization of a parent or legal guardian where required by law.

You may not use our Services for any unlawful, fraudulent, abusive, or unauthorized purpose.

3. Products

We make reasonable efforts to present our products accurately, including their descriptions, photographs, colors, features, sizing, and other relevant information.

However, colors and appearance may vary slightly depending on your device, screen settings, lighting, photography, and other factors.

Product measurements may also be subject to reasonable variations.

We reserve the right to update product descriptions, availability, specifications, and other information where reasonably necessary.

Nothing in this section limits your rights where a product is materially different from its description, defective, incorrect, or otherwise non-conforming under applicable law.

4. Product Availability

All products are subject to availability.

Adding an item to your cart does not guarantee that the product will remain available until your order has been successfully completed and accepted.

In rare circumstances, an item may become unavailable after an order is placed.

If we are unable to fulfill an item in your order, we may contact you to offer an appropriate alternative or issue a refund for the unavailable item.

We do not use product availability claims intended to create false or misleading scarcity.

5. Prices

Prices are displayed in the currency made available to you through our website or checkout.

If payment has already been collected for an order that we cancel, the applicable amount will be refunded to the original payment method.

8. Payments

Available payment methods will be displayed during checkout.

Payments may be processed through Shopify Payments or other authorized payment service providers made available through our store.

By submitting payment information, you represent that you are authorized to use the selected payment method.

Transactions may be subject to verification, authorization, fraud prevention, and security checks.

SOUVARE reserves the right to cancel or hold an order where reasonably necessary to investigate suspected fraud, unauthorized payment activity, or security concerns, subject to applicable law.

9. Shipping & Delivery

Orders are generally processed within 2–5 business days after successful payment confirmation.

Once dispatched, delivery is generally estimated within 10–20 business days.

Delivery times are estimates and may be affected by the destination, carrier operations, customs processing, local postal services, public holidays, weather, or circumstances outside our reasonable control.

Selected products may qualify for complimentary shipping. For other eligible products and destinations, complimentary standard shipping may be available on orders of US$100 or more.

10. International Orders, Duties & Taxes

International orders may be subject to customs duties, import taxes, VAT, brokerage charges, handling fees, or similar charges depending on the destination.

Where applicable, certain taxes or duties may be calculated and collected during checkout.

Where they are not collected at checkout, additional charges may be assessed by the relevant authority or carrier.

11. Returns & Refunds

Eligible products may be returned within 30 days of delivery, subject to the conditions established in our Returns Policy.

For standard returns resulting from change of mind, personal preference, or incorrect size selection, return shipping costs are generally the customer's responsibility.

Where an item arrives damaged, defective, or incorrect and the issue is confirmed, SOUVARE will cover the applicable costs associated with the approved return or other appropriate resolution.

Refunds for approved returns will generally be issued to the original payment method.

Nothing in these Terms limits mandatory rights relating to defective or non-conforming goods.

12. European Union Right of Withdrawal

Consumers located in the European Union may have statutory cancellation and withdrawal rights in addition to SOUVARE's commercial return policy.

For eligible online purchases, EU consumers generally have a 14-day statutory right of withdrawal after receiving the goods, subject to applicable exceptions. Shopify Help Center

SOUVARE's commercial 30-day return period does not replace or reduce those mandatory rights.

Where applicable, customers may exercise their statutory withdrawal rights using the electronic cancellation or withdrawal functionality made available through our store.

Since June 19, 2026, merchants selling online to EU consumers are required to provide a clearly visible electronic method through which eligible consumers can exercise their withdrawal rights. Shopify Help Center

13. Promotions and Discount Codes

From time to time, SOUVARE may offer promotional prices, private access, discount codes, complimentary shipping, or other offers.

Promotions may be subject to specific:

• Eligibility requirements;
• Dates;
• Product exclusions;
• Geographic restrictions;
• Minimum order values; or
• Other clearly disclosed conditions.

Unless expressly stated otherwise, promotional offers may not be combined.

SOUVARE may modify or discontinue a promotion where permitted by law, without affecting qualifying orders already completed under that promotion.

14. Accuracy of Information

We make reasonable efforts to ensure that information available through our Services is accurate and current.

Occasionally, information may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, availability, shipping, or other matters.

Where permitted by applicable law, we may correct errors and update information.

If a material error affects an order you have already placed, we will take reasonable steps to notify you and provide an appropriate resolution.

15. Intellectual Property

Unless otherwise stated, the SOUVARE website and its original content, including branding, wordmarks, logos, monograms, graphics, layouts, text, photographs owned or licensed by us, visual elements, and other original materials, are owned by or licensed to SOUVARE and are protected by applicable intellectual property laws.

The name SOUVARE, its visual identity, and related brand elements may not be reproduced, copied, distributed, modified, commercially exploited, or used in a manner that falsely suggests affiliation with SOUVARE without appropriate authorization.

You may access and use our website for personal, non-commercial shopping purposes.

Nothing in these Terms transfers ownership of any intellectual property rights to you.

16. Prohibited Uses

You may not use our website or Services to:

• Violate applicable laws or regulations;
• Commit or facilitate fraud;
• Infringe intellectual property rights;
• Submit false or misleading information;

Where you expressly submit content for publication or promotional use, you grant SOUVARE the permissions reasonably necessary to display, reproduce, and use that content for the purposes disclosed when it is submitted, subject to applicable law and privacy rights.

21. Fraud and Abuse

We reserve the right to investigate transactions, accounts, returns, refunds, promotions, or other activity where we reasonably suspect fraud or abuse.

Where permitted by applicable law, we may refuse transactions, cancel orders, restrict accounts, or take other reasonable protective measures.

This provision does not affect legitimate customer complaints, chargeback rights, statutory consumer protections, or lawful return and refund requests.

22. Disclaimer

We aim to provide accurate, reliable, and secure Services.

However, except for warranties, guarantees, or obligations that cannot legally be excluded, we do not guarantee that the website will always be uninterrupted, error-free, or continuously available.

Temporary interruptions may occur because of maintenance, technical problems, third-party systems, network disruptions, or circumstances outside our reasonable control.

Nothing in these Terms excludes warranties or guarantees that cannot legally be excluded.

23. Limitation of Liability

To the fullest extent permitted by applicable law, SOUVARE will not be liable for indirect, incidental, special, or consequential losses arising solely from your use of the Services where such liability may lawfully be limited.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, these Terms do not exclude or limit mandatory rights or remedies available to consumers under applicable law.

24. Indemnification

To the extent permitted by applicable law, you agree to indemnify SOUVARE against reasonable losses, liabilities, and expenses arising directly from your unlawful use of the Services, intentional violation of these Terms, or infringement of third-party rights.

This section does not apply where such indemnification would unlawfully restrict consumer rights.

25. Force Majeure

SOUVARE will not be responsible for delays or failures caused by events outside our reasonable control to the extent permitted by applicable law.

Such circumstances may include severe weather, natural disasters, transportation disruptions, carrier interruptions, customs delays, governmental actions, labor disruptions, telecommunications failures, or other extraordinary events.

Where an event materially affects an order, we will make reasonable efforts to provide information and an appropriate resolution.
